Baney Brew respects the intellectual property rights of breweries, beverage companies, and all other rights holders. This policy explains our stance on product ownership, copyright, trademarks, and how to submit a Digital Millennium Copyright Act (DMCA) takedown notice.
1. Ownership of Beers & Breweries
- All beers, brewery names, product images, trademarks, and branding displayed on Baney Brew remain the exclusive property of their rightful owners.
- Baney Brew makes no claim of ownership over third-party products or brands featured on our platform.
- Any unauthorized use, misrepresentation, or infringement of brewery products, branding, or trademarks is strictly prohibited.
2. User-Generated Content
- Users may post reviews, ratings, and photos of beers and breweries in compliance with these Terms.
- Users are not permitted to upload copyrighted content (e.g., logos, packaging, marketing materials) without the express permission of the rights holder.
- If found in violation, such content may be removed, and accounts may be suspended.
3. Prohibition of Piracy
- Piracy of copyrighted works (e.g., stolen brewery images, promotional content, or pirated software/tools posted on the platform) is strictly prohibited.
- Users engaging in piracy may face account termination and legal action.
4. DMCA Compliance
Baney Brew complies with the Digital Millennium Copyright Act (DMCA). If you are a copyright owner (or an authorized agent) and believe that your work has been used in a way that constitutes infringement, you may submit a DMCA takedown notice.
Your notice must include:
- Identification of the copyrighted work(s) you claim has been infringed.
- Identification of the infringing material (with specific URLs on Baney Brew).
- Your contact information (name, address, phone number, email).
- A statement that you have a good faith belief the use is not authorized.
- A statement, under penalty of perjury, that the information in your notice is accurate and you are the copyright owner (or authorized to act on their behalf).
- Your physical or electronic signature.

5. Counter-Notification
If you believe your content was removed by mistake or misidentification, you may submit a counter-notification to our DMCA agent. Your notice must include:
- Identification of the removed content and its location before removal.
- A statement under penalty of perjury that the material was removed due to mistake or misidentification.
- Your contact information and consent to the jurisdiction of your local federal district court.
- Your signature.
If valid, we may restore the content unless the original complainant files legal action within 10 business days.
6. Repeat Infringers
Accounts repeatedly violating intellectual property rights may be suspended or terminated.
